Treasury and IRS Propose New Premium Tax Credit Rules - Clear Start Tax Explains Why Marketplace Coverage Is a Common Source of a Surprise IRS Balance
Health Exchange subsidies are paid in advance on an income estimate, then squared up on the tax return. When the estimate is low, the difference does not stay with the insurance company. It becomes tax owed.
IRVINE, CA / ACCESS Newswire / October 30, 2026 / The Treasury Department and the IRS have issued proposed regulations implementing the Working Families Tax Cuts changes to the Premium Tax Credit, the refundable credit that subsidizes coverage purchased through Health Insurance Exchanges. Clear Start Tax says the announcement is a timely reminder for the millions of households whose health coverage is tied to an income estimate they made months ago, because that estimate is settled on the tax return and the shortfall arrives as a balance due.
Taxpayers who already owe a balance from a prior year marketplace reconciliation can review which resolution options apply to their situation before the next filing season begins.
"Almost nobody thinks of health insurance as a tax decision, but when the subsidy is paid in advance on an estimate, that is exactly what it is," said a spokesperson for Clear Start Tax, a national tax relief and resolution firm.
The Premium Tax Credit is a refundable credit that subsidizes the cost of health coverage purchased through a Health Insurance Exchange. On October 14, 2026, Treasury and the IRS issued proposed regulations implementing the changes the Working Families Tax Cuts made to that credit.
The IRS maintains a dedicated page describing the Working Families Tax Cuts provisions, and it lists its announcements for the period on its newsroom page for current month news releases. Taxpayers who rely on Exchange coverage should follow both as the proposals move forward, since the rules that govern the credit are what determine the figure that appears on the return.
"The pattern we see is a household that picked up extra work, took a bonus, or had a good year as a contractor. The coverage was priced on last spring's guess, and the correction shows up as a four figure line on a return they expected to be straightforward," the spokesperson said.
To help households with Exchange coverage avoid an unexpected balance and deal with one that already exists, Clear Start Tax recommends:
- Report income changes to the Exchange during the year rather than waiting for the return to catch them
- Keep every Form 1095-A, since the reconciliation cannot be completed accurately without it
- File on time even if the repayment amount cannot be paid, because the failure to file penalty is the larger one
- Treat an unpaid repayment as ordinary assessed tax, which means liens, levies and the standard relief programs all apply
- Confirm no earlier years are unfiled, since most resolution options require full filing compliance first
By answering a few questions about what is owed and how many years are unfiled, taxpayers can find out whether they qualify for relief under the IRS Fresh Start Program.
"People hear the words tax credit and assume the worst case is getting less of it. Once it has been advanced to the insurer on your behalf, the excess is assessed tax like any other, and the collection process does not treat it gently," the spokesperson added.
